Terms and Conditions
1. Scope
These Terms and Conditions (T&Cs) apply to all contracts concluded between DoorGuard (hereinafter "Provider") and customers (hereinafter "Customer") via the Provider's website. These T&Cs apply exclusively to orders delivered within Switzerland. Sales to other countries are currently excluded.
2. Information on this Website
The information and product descriptions on the Provider’s website are for general informational purposes only. They do not constitute a legally binding offer, but rather an invitation for the customer to submit an offer. Despite careful maintenance and updates, the Provider accepts no liability for the accuracy, completeness, or timeliness of the information provided.
3. Prices
All prices listed on the website are in Swiss francs (CHF) and do not include VAT, as the Provider is not subject to VAT. The Provider reserves the right to change prices at any time. The prices valid at the time of contract conclusion shall apply to the order.
4. Contract Conclusion
The presentation of products on the website does not constitute a legally binding offer, but an invitation to place an order. By submitting an order, the customer makes a binding offer to purchase the products in the cart.
Cancellations can be requested by the customer via email between contract conclusion and the moment the order is processed for delivery. The Provider reserves the right to accept or reject such requests without providing reasons.
If delivery does not occur within 12 months of contract conclusion, the full amount will be refunded and the order will be canceled.
5. Payment Methods and Retention of Title
The Provider offers various payment methods, such as credit card or bank transfer. Ownership of the delivered products remains with the Provider until full payment is received.
6. Delivery, Inspection Obligation, Notification of Defects, and Returns
Delivery is limited to addresses in Switzerland. The customer must inspect the goods immediately upon receipt and report obvious defects without delay. Hidden defects must be reported as soon as they are discovered. In the case of justified complaints within the 2-year warranty, the customer is entitled to a replacement delivery. Returns must be made according to the Provider’s instructions. Shipping costs will be covered by the Provider.
7. Right of Withdrawal
Each customer may return exactly one DoorGuard from their first order, regardless of the quantity ordered, within 30 days of the shipping date without giving reasons. The customer must complete the return form on the website within this period. The Provider will then provide a prepaid return label. A refund will only be issued once the product has been received by the Provider. For damage exceeding normal wear and tear, the Provider reserves the right to reduce the refund amount accordingly. The customer bears the risk of return shipping.
This return policy only applies to orders placed through this website and not to orders made via Kickstarter.
8. Warranty
The Provider warrants that the delivered products are free from material and manufacturing defects. Minor deviations common in SLA 3D printing do not constitute defects. The warranty period is two years from the date of delivery. In the event of a warranty claim, the customer is entitled to repair, replacement, or a refund. The Provider is not liable for normal wear or improper handling.
9. Liability
The Provider is not liable for any kind of damage caused by the product, especially not for indirect damages, consequential damages, or lost profits. The Provider assumes no liability for the content of linked external websites. Customers using the DoorGuard outside of Switzerland do so at their own risk, especially since the product does not have CE certification.
10. Data Protection
The Provider processes customers’ personal data exclusively for contract fulfillment and marketing purposes. Data is only shared with service providers necessary for delivery and order processing.
11. Severability
If any provision of these T&Cs is or becomes invalid, the validity of the remaining provisions remains unaffected. An appropriate provision that reflects the intent of the invalid provision shall take its place.
12. Additional Provisions
The Provider reserves the right to amend these T&Cs at any time. Contracts between the Provider and the customer are governed exclusively by Swiss law. The place of jurisdiction is the Provider’s registered office (Canton Aargau), unless otherwise required by law.
